Extraordinary
Ability (1st preference):
Individuals who have achieved a level of expertise such that
he/she is in the small percentage who have risen to the top
of their field are extraordinary. The ability is demonstrated
by sustained national or international acclaim. The individual
is coming to the U.S. to work in the recognized acclaim field.
No labor certification is required.
Regulations require either the award of a major international
prize, such as the Nobel Prize, Cleo Award or Academy Award
or by establishing the individual qualifies by meeting at
least 3 of 10 enumerated criteria listed in the regulations:
1. Receipt of lesser nationally or internationally recognized
prizes or awards;
2. Membership in associations in the field for which
the classification is sought requiring outstanding achievements
of their members;
3. Published material about the alien in professional
or major trade publications relating to the alien’s
work in the field for which classification is sought;
4. Participation as the judge of the work of others
in the same field;
5. Original scientific, scholarly, artistic, athletic,
or business related contributions;
6. Authorship of articles in professional or trade
publications;
7. Display of alien’s work at exhibitions
or showcases;
8. Performed in a leading or critical role for
organizations or establishments that have a distinguished
reputation; |
9. Commanded
a high salary or other significantly high remuneration for
services in relation to others in the field;
10. Commercial successes in the performing arts, as shown
by box office receipts, or record, cassette, compact disk
or video sales.
If the above standards do not apply to the alien’s occupation
the petitioner may submit comparable evidence to establish
eligibility for permanent resident status. |
